{"id":18910,"date":"2020-02-21T13:19:13","date_gmt":"2020-02-21T10:19:13","guid":{"rendered":"https:\/\/www.tkp.org.tr\/uncategorized\/socialist-constitution\/"},"modified":"2023-02-21T13:20:26","modified_gmt":"2023-02-21T10:20:26","slug":"socialist-constitution","status":"publish","type":"post","link":"https:\/\/www.tkp.org.tr\/en\/temel-metinler-en\/socialist-constitution\/","title":{"rendered":"Socialist Constitution"},"content":{"rendered":"<h3>TOPLUMCU B\u0130R ANAYASA \u0130\u00c7\u0130N&#8230; SUNU\u015e<\/h3>\n<p>T\u00fcrkiye\u2019de 12 Eyl\u00fcl darbe anayasas\u0131n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girmesinin \u00fczerinden 39 y\u0131l ge\u00e7ti. Hala 12 Eyl\u00fcl anayasas\u0131ndan kurtulmay\u0131 tart\u0131\u015f\u0131yoruz. Oysa ki ge\u00e7en 39 y\u0131l i\u00e7erisinde anayasa ve yasalarda bir\u00e7ok de\u011fi\u015fikli\u011fe gidildi. 2010 ve 2017 y\u0131llar\u0131nda AKP iktidar\u0131 eli ile \u00f6nerilen anayasa de\u011fi\u015fiklikleri i\u00e7in iki ayr\u0131 referandum ger\u00e7ekle\u015ftirildi. Ad\u0131na g\u00fc\u00e7lendirilmi\u015f Cumhurba\u015fkanl\u0131\u011f\u0131 da denilen Ba\u015fkanl\u0131k Sistemi gibi radikal bir de\u011fi\u015fikli\u011fe dahi gidildi. Ama T\u00fcrkiye yine 12 Eyl\u00fcl Anayasas\u0131&#8217;ndan kurtulmay\u0131 tart\u0131\u015f\u0131yor. Bu tart\u0131\u015fmalarda 12 Eyl\u00fcl Anayasas\u0131&#8217;n\u0131n bir kar\u015f\u0131 devrim anayasas\u0131 oldu\u011funun ise \u0131srarla \u00fcst\u00fc \u00f6rt\u00fclmeye devam ediliyor.<\/p>\n<p>T\u00fcrkiye Kom\u00fcnist Partisi taraf\u0131ndan haz\u0131rlanan ve kamuoyuna sunulan Toplumcu Anayasa\u2019n\u0131n 2007 y\u0131l\u0131ndaki ilk bas\u0131m\u0131n\u0131n sunu\u015f b\u00f6l\u00fcm\u00fcnde \u201c12 Eyl\u00fcl Anayasas\u0131&#8217;n\u0131n \u00f6z\u00fcnde i\u015f\u00e7i ve emek\u00e7ilerin \u00f6rg\u00fctlenme, siyaset yapma ve hak arama \u00f6zg\u00fcrl\u00fcklerinin yok edilme arzusu yatmaktad\u0131r&#8230;\u201d deniliyordu. Bug\u00fcne kadar anayasada de\u011fi\u015fikli\u011fe dair at\u0131lan somut her ad\u0131mda bu \u00f6z\u00fc de\u011fi\u015ftirmek de\u011fil, korumak ve g\u00fc\u00e7lendirmek esas al\u0131nd\u0131. Bug\u00fcn anayasa de\u011fi\u015fikli\u011finin bir kez daha g\u00fcndeme ta\u015f\u0131nmas\u0131n\u0131n \u00f6ncelikli sebebi de bu: B\u00fct\u00fcn gerici niteli\u011fine ra\u011fmen eldeki anayasa sermaye s\u0131n\u0131f\u0131n\u0131n talep ve ihtiya\u00e7lar\u0131na yan\u0131t \u00fcretmede yetersiz kal\u0131yor. Sermaye s\u0131n\u0131f\u0131 kendi \u00e7\u0131karlar\u0131 \u00f6n\u00fcnde engel olu\u015fturabilecek ne varsa temizlemek, aya\u011f\u0131na dolanan t\u00fcm anayasal k\u0131s\u0131tlamalardan kurtulmak istiyor.<\/p>\n<p>Anayasada laiklik, yurtseverlik, kamuculuk ilkelerine dair ka\u011f\u0131t \u00fcst\u00fcnde de olsa var olmaya devam eden tan\u0131mlardan tamamen kurtulmak da sermaye d\u00fczeni ve AKP iktidar\u0131n\u0131n ba\u015fka bir ihtiyac\u0131. Laiklik ile sosyal devlet ifadelerinin yerinin olmad\u0131\u011f\u0131 bir anayasal d\u00fczeni mutlak k\u0131lma \u00e7abas\u0131 i\u00e7indeler. Ciddi bir s\u0131k\u0131\u015fma ya\u015f\u0131yorlar. \u00c7\u0131k\u0131\u015f\u0131 ise T\u00fcrkiye\u2019de kurals\u0131z bir piyasac\u0131l\u0131k uygulanmas\u0131nda, emperyalizmle her t\u00fcr i\u015fbirli\u011finin ve yay\u0131lmac\u0131 e\u011filimlerin me\u015fru say\u0131lmas\u0131nda, siyaset ve toplumsal ya\u015fam\u0131n belirlenmesinde dinsel tan\u0131mlar\u0131n ge\u00e7erlili\u011finin art\u0131r\u0131lmas\u0131nda g\u00f6r\u00fcyorlar.<\/p>\n<p>Anayasa de\u011fi\u015fikli\u011fi tart\u0131\u015fmalar\u0131n\u0131n g\u00fcndeme gelmesindeki bir di\u011fer neden ise y\u00fcr\u00fcrl\u00fckteki anayasa ve hukuk sisteminin i\u015flemez hale gelmesi ve me\u015fruiyet kayb\u0131. D\u00fczenin iyile\u015ftirilebilece\u011fi g\u00f6r\u00fc\u015f ve alg\u0131s\u0131n\u0131n toplumda g\u00fc\u00e7lenmesi ve etkili olmas\u0131n\u0131n bir arac\u0131 olarak anayasa tart\u0131\u015fmalar\u0131n\u0131 g\u00fcndeme getiriyorlar.<\/p>\n<p>Ancak AKP iktidar\u0131n\u0131n T\u00fcrkiye\u2019de yeni bir anayasa yapma ehliyeti de hakk\u0131 da bulunmuyor. 20 y\u0131ll\u0131k iktidar\u0131 boyunca bu g\u00fcndeme dair yapt\u0131klar\u0131 da bunu g\u00f6steriyor. AKP T\u00fcrkiye\u2019de kurucu de\u011fil bozucu ve kar\u015f\u0131 devrimci bir iradeyi temsil ediyor. Bu sebeple AKP eli ile g\u00fcndeme getirilmeye \u00e7al\u0131\u015f\u0131lan anayasa de\u011fi\u015fikli\u011fi tart\u0131\u015fmas\u0131n\u0131n teredd\u00fcts\u00fcz reddedilmesi gerekiyor. AKP\u2019den ve bu giri\u015fimden emek\u00e7iler lehine hi\u00e7bir \u015fey \u00e7\u0131kmayaca\u011f\u0131 \u00e7ok a\u00e7\u0131k.<\/p>\n<p>Yukar\u0131da belirttik, T\u00fcrkiye\u2019nin ya\u015fad\u0131\u011f\u0131 adaletsizlik, e\u015fitsizlik, gericilik ve bask\u0131n\u0131n kayna\u011f\u0131 sermaye egemenli\u011fi ve onun s\u00f6m\u00fcr\u00fc d\u00fczeni. 12 Eyl\u00fcl Anayasas\u0131 da, AKP iktidar\u0131 da, Ba\u015fkanl\u0131k Sistemi de bu d\u00fczenin ihtiya\u00e7lar\u0131na denk d\u00fc\u015fen birer karanl\u0131k sonu\u00e7.<\/p>\n<p>D\u00fcn 12 Eyl\u00fcl karanl\u0131\u011f\u0131ndan kurtulma iddias\u0131 ile ortaya at\u0131lan anayasa tart\u0131\u015fmalar\u0131na verdi\u011fimiz yan\u0131t, bug\u00fcn iktidar ve muhalefet ile g\u00fcndeme getirilen anayasa tart\u0131\u015fmalar\u0131 i\u00e7in de ge\u00e7erlili\u011fini koruyor: T\u00fcrkiye\u2019de adaletin, e\u015fitli\u011fin, \u00f6zg\u00fcrl\u00fc\u011f\u00fcn sa\u011flanabilmesi ancak toplumcu bir anayasa ile m\u00fcmk\u00fcn. Toplumcu Anayasa\u2019n\u0131n muhattab\u0131 ise sadece ve sadece emek\u00e7i halk.<\/p>\n<p>B\u0130R\u0130NC\u0130 B\u00d6L\u00dcM * TAR\u0130HSEL M\u0130RAS<\/p>\n<p>Bir sosyalist devlet olarak T\u00fcrkiye Cumhuriyeti, \u00fclkede ya\u015fayan t\u00fcm uluslardan i\u015f\u00e7ilerin, emek\u00e7ilerin, k\u00f6yl\u00fclerin, ayd\u0131nlar\u0131n ortak \u00e7abas\u0131n\u0131n \u00fcr\u00fcn\u00fc olacakt\u0131r.<\/p>\n<p>Sosyalist cumhuriyet, y\u00fczy\u0131llardan bu yana bu co\u011frafyada boy atm\u0131\u015f b\u00fct\u00fcn ilerici at\u0131l\u0131mlar\u0131n, bu at\u0131l\u0131mlar\u0131n \u00f6nc\u00fc g\u00fcc\u00fc olan toplumsal hareketlerin, halk kahramanlar\u0131n\u0131n miras\u0131n\u0131 devral\u0131p gelecek ku\u015faklara ta\u015f\u0131yacakt\u0131r.<\/p>\n<p>Osmanl\u0131 \u0130mparatorlu\u011fu\u2019nun Birinci D\u00fcnya Sava\u015f\u0131 ile birlikte emperyalistlerce par\u00e7alanmas\u0131, Anadolu halklar\u0131n\u0131n ortak tarihinde en \u00f6nemli geli\u015fmelerden bir tanesidir. Bu geli\u015fmeye kar\u015f\u0131 m\u00fccadele, 1917 Ekim Devrimi\u2019nin sonucu olarak ortaya \u00e7\u0131kan Sovyetler Birli\u011fi\u2019nin de deste\u011fini alarak, k\u0131sa s\u00fcre i\u00e7erisinde bat\u0131l\u0131 emperyalist \u00fclkelerin planlar\u0131n\u0131 bozmu\u015f ve T\u00fcrkiye Cumhuriyeti\u2019nin temelleri bu m\u00fccadelede at\u0131lm\u0131\u015ft\u0131r. Sosyalist devletimizin devralaca\u011f\u0131 tarihsel miras\u0131n en \u00f6nemli halkalar\u0131ndan birisi bu m\u00fccadele ve bu m\u00fccadelenin \u00fcr\u00fcn\u00fc olarak T\u00fcrkiye Cumhuriyeti\u2019dir.<\/p>\n<p>Emek\u00e7ilerin iktidar\u0131n\u0131 temsil edecek olan T\u00fcrkiye Cumhuriyeti ise, s\u00f6z konusu m\u00fccadelenin hemen ba\u015flang\u0131c\u0131ndan itibaren kendi s\u0131n\u0131fsal \u00e7\u0131karlar\u0131 do\u011frultusunda egemenli\u011fini ilan eden burjuva s\u0131n\u0131f\u0131na kar\u015f\u0131 tarihsel hesapla\u015fman\u0131n \u00fcr\u00fcn\u00fc olacakt\u0131r. T\u00fcrkiye Cumhuriyeti, sermaye s\u0131n\u0131f\u0131n\u0131n elinde emek\u00e7i halka kar\u015f\u0131 kullan\u0131lm\u0131\u015f, emperyalist ya\u011fma ve talana a\u00e7\u0131k hale getirilmi\u015f, gericili\u011fe ve karanl\u0131\u011fa teslim edilmi\u015ftir. 1923 y\u0131l\u0131nda ilan edilen cumhuriyet, i\u015fbirlik\u00e7i s\u00f6m\u00fcr\u00fcc\u00fc g\u00fc\u00e7lerin elinde, kendi ilkelerine ihanet etmi\u015ftir. Cumhuriyet fikri ba\u011f\u0131ml\u0131l\u0131k<\/p>\n<p>ili\u015fkilerine, gericili\u011fe, s\u00f6m\u00fcr\u00fcye kar\u015f\u0131 harekete ge\u00e7en T\u00fcrk, K\u00fcrt b\u00fct\u00fcn uluslardan emek\u00e7ilerin \u00e7abas\u0131yla vatan haini ve mandac\u0131 s\u00f6m\u00fcr\u00fcc\u00fc s\u0131n\u0131flar\u0131n ala\u015fa\u011f\u0131 edilmesi sonucunda ger\u00e7ek kar\u015f\u0131l\u0131\u011f\u0131n\u0131 bulacak ve T\u00fcrkiye Cumhuriyeti ulusal egemenli\u011fi, \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve e\u015fitli\u011fi bayrak yapan sayg\u0131n bir \u00fclkeye d\u00f6n\u00fc\u015ft\u00fcr\u00fclecektir. Bu d\u00f6n\u00fc\u015f\u00fcmler i\u00e7in k\u00f6kl\u00fc bir alt\u00fcst olu\u015f anlam\u0131na gelen sosyalist devrim, Toplumcu Anayasa\u2019y\u0131 uygulamak i\u00e7in gerekli siyasi ko\u015fullar\u0131 yaratacakt\u0131r.<\/p>\n<p>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM * TEMEL H\u00dcK\u00dcMLER<\/p>\n<p><b>Madde<\/b><b> 1- <\/b>T\u00fcrkiye Cumhuriyeti, dil, din, \u0131rk ve cinsiyet ayr\u0131m\u0131 g\u00f6zetmeksizin, T\u00fcrkiye\u2019de ya\u015fayan i\u015f\u00e7ilerin, k\u00f6yl\u00fclerin ve t\u00fcm emek\u00e7ilerin ortak iradesini temsil eden ve \u00e7\u0131karlar\u0131n\u0131 savunan egemen bir sosyalist devlettir.<\/p>\n<p><b>Madde<\/b><b> 2- <\/b>\u0130nsan\u0131n insan\u0131 s\u00f6m\u00fcrmesine yol a\u00e7acak hi\u00e7bir i\u015f, i\u015flem, eylem ve d\u00fczenleme yap\u0131lamaz; bunu g\u00fcvence alt\u0131na alacak \u00f6nlemlerin tasarlan\u0131p uygulanmas\u0131, devletin birincil g\u00f6revleri aras\u0131ndad\u0131r.<\/p>\n<p><b>Madde<\/b><b> 3- <\/b>Siyasal ya\u015fam ve devlet i\u015fleri, t\u00fcm\u00fcyle ya da bir b\u00f6l\u00fcm\u00fcyle, dine ve din kurallar\u0131na dayand\u0131r\u0131lamaz. Dini inan\u00e7 bireysel bir tercihtir; her yurtta\u015f herhangi bir dine inanmakta ya da hi\u00e7bir dine inanmamakta, bunlar\u0131 a\u00e7\u0131klay\u0131p a\u00e7\u0131klamamakta \u00f6zg\u00fcrd\u00fcr.<\/p>\n<p><b>Madde<\/b><b> 4- <\/b>Farkl\u0131 ulus ve halklar\u0131n \u00f6zg\u00fcrce bir arada ya\u015fad\u0131\u011f\u0131 T\u00fcrkiye Cumhuriyeti\u2019nde b\u00fct\u00fcn yurtta\u015flar etnik ya da ulusal k\u00f6kenlerine bak\u0131lmaks\u0131z\u0131n e\u015fit haklardan yararlan\u0131rlar. T\u00fcrkiye Cumhuriyeti\u2019nin egemen bir sosyalist devlet olarak \u00f6rg\u00fctlenmesinde ve e\u015fitlik\u00e7i toplumsal d\u00fczenin kurulmas\u0131 ve korunmas\u0131nda hi\u00e7bir halk ya da ulus di\u011ferlerinden daha fazla rol ve sorumlulu\u011fa sahip de\u011fildir.<\/p>\n<p><b>Madde <\/b><b>5-<\/b><b> <\/b>Anayasan\u0131n ilk d\u00f6rt maddesindeki h\u00fck\u00fcmlerin dokunulmazl\u0131\u011f\u0131, \u00f6rg\u00fctl\u00fc toplumun g\u00fcvencesi alt\u0131ndad\u0131r.<\/p>\n<p>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM * S\u0130YASAL YAPI<\/p>\n<p><b>Madde<\/b><b> 6- <\/b>T\u00fcrkiye Cumhuriyeti&#8217;nde iktidar bir sosyalist demokrasi olarak \u00f6rg\u00fctlenir. T\u00fcrkiye Cumhuriyeti&#8217;nde i\u015f\u00e7i s\u0131n\u0131f\u0131, toplumsal \u00f6rg\u00fctlenmeleri arac\u0131l\u0131\u011f\u0131yla do\u011frudan y\u00f6netimdedir. \u0130ktidar organlar\u0131 fabrikalar, at\u00f6lyeler, b\u00fcrolar, \u00e7iftlikler, okullar ve k\u0131\u015flalardan ba\u015flayarak yukar\u0131ya do\u011fru uzan\u0131r. Yerel meclisler, toplumun t\u00fcm kesimlerini y\u00f6netime katacak birer ara\u00e7t\u0131r.<\/p>\n<p><b>Madde<\/b><b> 7- <\/b>Devlet ve t\u00fcm organlar\u0131 yurtta\u015flar\u0131n temel hak ve \u00f6zg\u00fcrl\u00fcklerini g\u00fcvence alt\u0131na alan ve emek\u00e7i kesimlerin \u00e7\u0131karlar\u0131n\u0131 savunan bir hukuk sistemi \u00e7er\u00e7evesinde etkinliklerini y\u00fcr\u00fct\u00fcr. T\u00fcm devlet \u00f6rg\u00fct\u00fc, kurulu\u015flar ve g\u00f6revliler T\u00fcrkiye Cumhuriyeti Anayasas\u0131\u2019na ve hukuk sistemine uyarlar, kayna\u011f\u0131n\u0131 yasalardan ve anayasadan almayan hi\u00e7bir yetki kullanamazlar. Kimsenin g\u00f6revi dolay\u0131s\u0131yla yasal dokunulmazl\u0131\u011f\u0131 olamaz.<\/p>\n<p><b>Madde<\/b><b> 8- <\/b>T\u00fcrkiye Cumhuriyeti&#8217;nde y\u00f6netim kademelerini a\u015fa\u011f\u0131dan yukar\u0131ya olu\u015fturan b\u00fct\u00fcn \u00f6rg\u00fctlenmeler, kendi y\u00f6netimlerini \u00f6zg\u00fcr se\u00e7imlerle belirler. Siyasal parti ve toplumsal \u00f6rg\u00fctlenmeler ile t\u00fcm yurtta\u015flar y\u00f6netim organlar\u0131na aday g\u00f6sterebilirler, aday olabilirler. Se\u00e7menler, b\u00fct\u00fcn organlara se\u00e7tikleri temsilci ve g\u00f6revlileri temsil ve g\u00f6rev d\u00f6nemleri tamamlanmadan &#8220;geri \u00e7a\u011f\u0131rma&#8221; hakk\u0131na sahiptirler. Bu hakk\u0131n kullan\u0131m\u0131 yasalarla d\u00fczenlenir ve g\u00fcvence alt\u0131na al\u0131n\u0131r. Se\u00e7im s\u00fcre\u00e7leri ilgili yasalarla d\u00fczenlenir.<\/p>\n<p><b>Madde<\/b><b> 9- <\/b>T\u00fcrkiye Cumhuriyeti\u2019nde yasama, h\u00fck\u00fcmet olu\u015fturma ve y\u00fcr\u00fctmeyi denetleme konular\u0131nda en y\u00fcksek organ Y\u00fcksek Meclis&#8217;tir. Y\u00fcksek Meclis, yerel iktidar organlar\u0131yla ba\u011flant\u0131l\u0131 olarak \u00e7al\u0131\u015f\u0131r ve onlarla bir b\u00fct\u00fcn olu\u015fturur. Y\u00fcksek Meclis i\u00e7 ve d\u0131\u015f politika, savunma, e\u011fitim ve sa\u011fl\u0131k, merkezi planlama, d\u0131\u015f ticaret ve merkezi b\u00fct\u00e7enin haz\u0131rlanmas\u0131 konular\u0131nda kendi g\u00f6rev ve yetkilerini ba\u015fka organlara devredemez ve payla\u015famaz. Y\u00fcksek Meclis iki y\u0131ll\u0131\u011f\u0131na ve t\u00fcm se\u00e7menlerin kat\u0131laca\u011f\u0131 tek dereceli se\u00e7imlerle belirlenir. Y\u00fcksek Meclis se\u00e7imlerinde her kent bir se\u00e7im b\u00f6lgesidir. Her kentten ka\u00e7 temsilcinin Y\u00fcksek Meclis\u2019te temsil edilece\u011fi, n\u00fcfusa g\u00f6re belirlenir.<\/p>\n<p><b>Madde<\/b><b> 10- <\/b>Y\u00fcksek Meclis Ba\u015fkan\u0131, meclis oturumlar\u0131na ba\u015fkanl\u0131k eder, meclisi yurti\u00e7inde ve yurtd\u0131\u015f\u0131nda temsil eder. Y\u00fcksek Meclis Ba\u015fkan\u0131 ilk oturumda meclis taraf\u0131ndan iki y\u0131ll\u0131\u011f\u0131na se\u00e7ilir.<\/p>\n<p><b>Madde<\/b><b> 11- <\/b>Bakanlar Konseyi, bir kurul olarak, devletin g\u00fcnl\u00fck y\u00fcr\u00fctme faaliyetlerinden en \u00fcst d\u00fczeyde sorumludur. Bakanlar Konseyi, Y\u00fcksek Meclis \u00fcyeleri aras\u0131ndan ve Y\u00fcksek Meclis taraf\u0131ndan se\u00e7ilerek olu\u015fturulur. G\u00f6rev s\u00fcresi iki y\u0131ld\u0131r.<\/p>\n<p><b>Madde<\/b><b> 12- <\/b>Devlet Ba\u015fkan\u0131, Bakanlar Konseyi\u2019ne ba\u015fkanl\u0131k eder. T\u00fcrkiye Cumhuriyeti Devleti\u2019nin yurti\u00e7inde ve yurtd\u0131\u015f\u0131nda en \u00fcst d\u00fczey temsilcisidir. Y\u00fcksek Meclis Ba\u015fkan\u0131&#8217;n\u0131n se\u00e7ilmesinin ard\u0131ndan yap\u0131lacak ilk oturumda, Y\u00fcksek Meclis taraf\u0131ndan iki y\u0131ll\u0131\u011f\u0131na se\u00e7ilir.<\/p>\n<p><b>Madde<\/b><b> 13- <\/b>Y\u00fcksek Meclis Ba\u015fkan\u0131, Bakanlar Konseyi ve Devlet Ba\u015fkan\u0131\u2019n\u0131n se\u00e7im s\u00fcreci ve sorumluluklar\u0131 ilgili yasalarla d\u00fczenlenir.<\/p>\n<p><b>Madde<\/b><b> <\/b><b>14-<\/b><b> <\/b>Mahalle ve k\u00f6y meclisleri t\u00fcm yurtta\u015flar\u0131 kapsayan yayg\u0131n toplumsal \u00f6rg\u00fctlerdir. Se\u00e7me ve se\u00e7ilme hakk\u0131na sahip t\u00fcm yurtta\u015flar mahalle ve k\u00f6y meclislerine \u00fcyedirler. Mahalle ve k\u00f6y meclisleri iki y\u0131lda bir \u00e7al\u0131\u015fmalar\u0131 y\u00f6nlendirmek i\u00e7in bir komite, il\u00e7e meclisinde g\u00f6rev alacak temsilcileri ve kendileriyle ilgili mahkemelerde ba\u011f\u0131ms\u0131z yarg\u0131\u00e7larla birlikte \u00e7al\u0131\u015facak mahkeme \u00fcyelerini se\u00e7erler. Kent meclisleri, o kentteki il\u00e7e meclislerinin iki y\u0131ll\u0131\u011f\u0131na se\u00e7ece\u011fi temsilcilerden olu\u015fur.<\/p>\n<p><b>Madde<\/b><b> 18- <\/b>T\u00fcrkiye Cumhuriyeti&#8217;nde, Y\u00fcksek Meclis&#8217;e ve \u00f6teki yerel meclislere se\u00e7ilen temsilciler, \u00fcretim ve karar mekanizmalar\u0131 aras\u0131ndaki ba\u011flar\u0131n dolay\u0131ms\u0131z duruma getirilmesi gere\u011finden dolay\u0131 se\u00e7ilmeden \u00f6nceki i\u015f, g\u00f6rev ya da \u00f6\u011frenimlerine devam ederler. Y\u00fcksek Meclis ve di\u011fer meclislere se\u00e7ilen temsilcilere bu g\u00f6revlerinden dolay\u0131 herhangi bir ek maa\u015f \u00f6denmez.<\/p>\n<p><b>Madde<\/b><b> 19- <\/b>Y\u00f6netim mekanizmalar\u0131n\u0131n ve buradaki g\u00f6revlilerin emek\u00e7i halktan kopmalar\u0131 ve toplumun \u00e7\u0131karlar\u0131n\u0131 g\u00f6z ard\u0131 etmeleri engellenir. Devlet \u00f6rg\u00fctlenmesinde y\u00f6neticilik sorumlulu\u011fu olan ki\u015filerin b\u00fct\u00fcn toplumsal \u00f6rg\u00fctlenmelerin gereksinim ve sorunlar\u0131ndan d\u00fczenli bi\u00e7imde haberdar olmalar\u0131n\u0131 sa\u011flayacak, toplumsal olarak denetlenen ileti\u015fim mekanizmalar\u0131 kurulur. Y\u00f6neticilerin g\u00f6revlerini yerine getirebilmeleri i\u00e7in onlara sa\u011flanacak olanaklar, toplumsal olarak izlenebilir ve denetlenebilir saydaml\u0131kta, ki\u015fisellikten uzak, y\u00f6neticilerin kolektif \u00e7al\u0131\u015fma bilin\u00e7lerini her zaman diri tutacak nitelikte olacakt\u0131r.<\/p>\n<p>D\u00d6RD\u00dcNC\u00dc B\u00d6L\u00dcM * EKONOM\u0130K YAPI<\/p>\n<p><b>Madde<\/b><b> 20- <\/b>Ekonomik etkinliklerin temel amac\u0131, t\u00fcm toplumun refah i\u00e7inde ya\u015famas\u0131, yurtta\u015flar\u0131n ya\u015fama ko\u015fullar\u0131n\u0131n her ge\u00e7en g\u00fcn iyile\u015ftirilmesidir.<\/p>\n<p><b>Madde<\/b><b> 21- <\/b>Toplumdaki e\u015fitsizliklerin as\u0131l kayna\u011f\u0131 olan \u00fcretim ara\u00e7lar\u0131ndaki \u00f6zel m\u00fclkiyetin belli bir program \u00e7er\u00e7evesinde t\u00fcm\u00fcyle ortadan kald\u0131r\u0131lmas\u0131, ekonomik politikalar\u0131n temel y\u00f6neli\u015fini olu\u015fturur. \u00dcretim ara\u00e7lar\u0131nda kamu m\u00fclkiyetinin d\u0131\u015f\u0131ndaki bi\u00e7imlerin tasfiye edilmesi s\u00fcrecinde, \u00fcretimin s\u00fcreklili\u011finin sa\u011flanmas\u0131 ve emek\u00e7ilerin siyasal ve ideolojik inisiyatifinin bu s\u00fcrecin temel g\u00fcc\u00fc olmas\u0131 i\u00e7in gerekli \u00f6nlemler al\u0131n\u0131r. Toplumsal kaynaklar\u0131n israf\u0131, r\u00fc\u015fvet, yetkilerin k\u00f6t\u00fcye kullan\u0131lmas\u0131, disiplinsizlik ve tembellik gibi olgulara kar\u015f\u0131 etkili y\u00f6netsel, ideolojik ve ekonomik \u00f6nlemler al\u0131n\u0131r; bu do\u011frultuda yasal d\u00fczenlemeler yap\u0131l\u0131r ve bu d\u00fczenlemelerin s\u00fcrekli olarak g\u00fcncelle\u015ftirilmesi g\u00f6zetilir.<\/p>\n<p><b>Madde<\/b><b> 23- <\/b>B\u00fct\u00fcn ekonomik etkinlikler ve ekonomik geli\u015fme, merkezi olarak planlan\u0131r. Planlama s\u0131n\u0131f \u00e7eli\u015fkilerinin ortadan kalkmas\u0131n\u0131, ekonominin b\u00fct\u00fcn \u00f6\u011felerinin uyumunun sa\u011flanmas\u0131n\u0131, \u00fclkenin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n peki\u015ftirilmesini ve \u00fcretimin toplum yarar\u0131na ve do\u011faya zarar vermeden ger\u00e7ekle\u015fmesini hedefler. Planlama, tabandan ba\u015flayarak emek\u00e7i inisiyatifinin geli\u015fmesi ve \u00fcretim s\u00fcrecindeki karar mekanizmalar\u0131n\u0131n payla\u015f\u0131mc\u0131 ve kat\u0131l\u0131mc\u0131 bir nitelik kazanmas\u0131 ile ya\u015fama ge\u00e7irilir. B\u00fct\u00fcn planlama s\u00fcreci boyunca, insanl\u0131\u011f\u0131n bilimsel ve teknolojik birikiminin toplum yarar\u0131na kullan\u0131lmas\u0131na ve geli\u015ftirilmesine \u00f6ncelik verilir.<\/p>\n<p><b>Madde<\/b><b> 24- <\/b>T\u00fcrkiye\u2019nin toprak, madenler, enerji, nitelikli i\u015fg\u00fcc\u00fc gibi yeterince sahip oldu\u011fu kendi kaynaklar\u0131na dayanan bir kalk\u0131nma at\u0131l\u0131m\u0131 \u00f6rg\u00fctlenir ve \u00fclke ekonomisinin d\u0131\u015fa ba\u011f\u0131ml\u0131l\u0131\u011f\u0131na son verilir. Di\u011fer \u00fclkelerle ekonomik ili\u015fkiler kar\u015f\u0131l\u0131kl\u0131 yararlar g\u00f6zetilerek ve \u00fclkenin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ile toplumsal \u00e7\u0131karlarlar korunarak s\u00fcrd\u00fcr\u00fcl\u00fcr. D\u0131\u015f ticaret devlet eliyle y\u00fcr\u00fct\u00fcl\u00fcr.<\/p>\n<p><b>Madde<\/b><b> <\/b><b>26-<\/b><b> <\/b>Ekonomik etkinlikler sonunda elde edilen t\u00fcm zenginlikler, toplumun kolektif ihtiya\u00e7lar\u0131 i\u00e7in gereken miktar ayr\u0131ld\u0131ktan sonra, emek\u00e7ilere \u00fccret olarak geri d\u00f6ner. \u00c7al\u0131\u015fabilir durumdaki her yurtta\u015f\u0131n toplumsal \u00fcretime yeteneklerine uygun olarak eme\u011fiyle kat\u0131lmas\u0131 ve bu katk\u0131s\u0131 ile uyumlu bir kar\u015f\u0131l\u0131k almas\u0131 g\u00f6zetilir.<\/p>\n<p><b>Madde<\/b><b> <\/b><b>27-<\/b><b> <\/b>\u00c7al\u0131\u015fma s\u00fcresinin k\u0131salt\u0131lmas\u0131, insan\u0131n b\u00fct\u00fcn boyutlar\u0131yla geli\u015febilmesinin \u00f6nko\u015fullar\u0131ndan ve toplumun ba\u015fl\u0131ca hedeflerinden biridir. \u00c7al\u0131\u015fma s\u00fcresi haftada 35 saati ge\u00e7emez. Fiziksel emek kullan\u0131m\u0131n\u0131 en aza indirmek ve t\u00fcm emek\u00e7ilerin zihinsel \u00fcretim potansiyelini harekete ge\u00e7irmek de bir ba\u015fka temel hedeftir. Devlet bu iki temel hakk\u0131 hi\u00e7bir durumdan ortadan kald\u0131ramaz, buna yol a\u00e7an ko\u015fullar\u0131n varl\u0131\u011f\u0131na g\u00f6z yumamaz.<\/p>\n<p><b>Madde<\/b><b> <\/b><b>29-<\/b><b> <\/b>\u00c7al\u0131\u015famayacak durumda olanlar, ya\u015fl\u0131lar ve emekliler devletin g\u00fcvencesi alt\u0131ndad\u0131rlar. Bu yurtta\u015flara insanca bir ya\u015fam d\u00fczeyi ve e\u015fit olanaklar sa\u011flan\u0131r.<\/p>\n<p><b>Madde<\/b><b> 30- <\/b>\u00dcstlendi\u011fi toplumsal rollerin gere\u011fini yerine getirerek \u00e7al\u0131\u015fan her yurtta\u015f, tatil yapma hakk\u0131na sahiptir. Bu hakk\u0131n herkes i\u00e7in kullan\u0131labilir k\u0131l\u0131nmas\u0131 devletin ve b\u00fct\u00fcn toplumsal \u00fcretim birimlerinin g\u00f6revleri aras\u0131nda yer al\u0131r. Tatil s\u00fcreleri ve bi\u00e7imleri, toplumsal ihtiya\u00e7lar ve olanaklar \u00e7er\u00e7evesinde belirlenir.<\/p>\n<p><b>Madde<\/b><b> 31- <\/b>Sendikala\u015fma ve grev hakk\u0131 t\u00fcm emek\u00e7ileri kapsayacak bi\u00e7imde yasalarla g\u00fcvence alt\u0131na al\u0131n\u0131r. Sendikalar ve i\u015fyerlerindeki iktidar organlar\u0131, \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n iyile\u015ftirilmesi, i\u015f\u00e7ilerin dinlenme, k\u00fclt\u00fcr ve spor olanaklar\u0131n\u0131n geni\u015fletilmesi i\u00e7in yetkilidirler.<\/p>\n<p><b>Madde<\/b><b> 32- <\/b>\u00dcretim s\u00fcrecinde i\u015f\u00e7inin kendi eme\u011fine ve eme\u011finin \u00fcr\u00fcnlerine kar\u015f\u0131 yabanc\u0131la\u015fmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7mek i\u00e7in gereken her t\u00fcrl\u00fc \u00f6nlem al\u0131n\u0131r.<\/p>\n<p><b>Madde<\/b><b> 33- <\/b>Tar\u0131m emek\u00e7ileri, \u00f6zg\u00fcr \u00e7ift\u00e7iler olarak kolektif \u00e7iftliklerde ve tar\u0131m i\u015f\u00e7ileri olarak devlet i\u015fletmelerinde bir araya gelirler. D\u0131\u015fa ba\u011f\u0131ml\u0131l\u0131\u011f\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclen tar\u0131msal \u00fcretimde, kolektif \u00e7iftliklerin kamu m\u00fclkiyetine uyumlu ve onunla \u00e7eli\u015fmeyecek bi\u00e7imler bulmas\u0131 sa\u011flan\u0131r. T\u00fcrkiye Cumhuriyeti s\u0131n\u0131rlar\u0131 i\u00e7inde birlikte ya\u015famak ve t\u00fcm b\u00f6lgelerin e\u015fit geli\u015fimini sa\u011flamak temel hedeftir. Devlet, bu hedef do\u011frultusunda t\u00fcm yurtta\u015flar\u0131n, enternasyonalist ve yurtsever bir bilin\u00e7le e\u011fitilmesinden, ya\u015fayan dillerin korunmas\u0131 ve \u00f6\u011fretilmesinden, bu dillerle e\u011fitim ve \u00f6\u011fretim hakk\u0131n\u0131n sa\u011flanmas\u0131ndan, k\u00fclt\u00fcrel zenginliklerimizin geli\u015ftirilmesinden sorumludur.<\/p>\n<p><b>Madde<\/b><b> 38- <\/b>16 ya\u015f\u0131na girmi\u015f her yurtta\u015f, b\u00fct\u00fcn y\u00f6netim kademeleri i\u00e7in se\u00e7me ve se\u00e7ilme hakk\u0131na sahiptir.<\/p>\n<p><b>Madde<\/b><b> 39- <\/b>T\u00fcrkiye Cumhuriyeti&#8217;nin t\u00fcm yurtta\u015flar\u0131, anlat\u0131m, propaganda ve \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fcne sahiptirler. \u0130nsan\u0131n insan\u0131 s\u00f6m\u00fcrmesini a\u00e7\u0131k ya da dolayl\u0131 bi\u00e7imde savunan, sava\u015f k\u0131\u015fk\u0131rt\u0131c\u0131s\u0131, din istismarc\u0131s\u0131, \u0131rk\u00e7\u0131 ve fa\u015fist d\u00fc\u015f\u00fcnceler toplumun \u00f6zg\u00fcr geli\u015fiminin \u00f6n\u00fcnde engel olu\u015fturduklar\u0131 i\u00e7in propaganda ve \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fcklerinden yararlanamazlar.<\/p>\n<p><b>Madde<\/b><b> 40- <\/b>Temel \u00f6zg\u00fcrl\u00fcklerin ya\u015fama ge\u00e7irilmesi i\u00e7in yaz\u0131l\u0131 ve g\u00f6rsel ileti\u015fim, toplant\u0131 ve g\u00f6steri yapma olanaklar\u0131 b\u00fct\u00fcn toplumsal \u00f6rg\u00fctlenmelerin hizmetine verilir.<\/p>\n<p><b>Madde<\/b><b> 41- <\/b>T\u00fcrkiye Cumhuriyeti&#8217;nin t\u00fcm yurtta\u015flar\u0131 \u00e7al\u0131\u015fma hakk\u0131na sahiptirler. T\u00fcm yurtta\u015flar, yapt\u0131klar\u0131 i\u015fin kar\u015f\u0131l\u0131\u011f\u0131nda, devlet taraf\u0131ndan belirlenmi\u015f bir standart\u0131n alt\u0131na d\u00fc\u015fmeksizin, \u00fccretlendirilirler. T\u00fcm yurtta\u015flar, yetenek, e\u011fitim ve e\u011filimleri do\u011frultusunda, toplumun ihtiya\u00e7lar\u0131 g\u00f6zetilerek, istedikleri meslek ve i\u015fi se\u00e7ebilirler. Bu hak, sosyalist ekonomik sistemin d\u00fczenli geli\u015fimiyle g\u00fcvence alt\u0131na al\u0131n\u0131r.<\/p>\n<p><b>Madde<\/b><b> 42- <\/b>T\u00fcrkiye Cumhuriyeti yurtta\u015flar\u0131n\u0131n, seyahat etme serbestli\u011fi, konut dokunulmazl\u0131\u011f\u0131, ve haberle\u015fme gizlili\u011fi devlet g\u00fcvencesi alt\u0131ndad\u0131r.<\/p>\n<p><b>Madde<\/b><b> 43- <\/b>Sorgulama ve kovu\u015fturma s\u0131ras\u0131nda devletin g\u00f6zetiminde tutulan ki\u015filere fiziki veya manevi bask\u0131 yap\u0131lamaz. Hi\u00e7 kimseye, hi\u00e7bir ko\u015ful ve durumda i\u015fkence uygulanamaz. Yasalarda yaz\u0131lan su\u00e7\u00fcst\u00fc durumlar\u0131 d\u0131\u015f\u0131nda hi\u00e7 kimse savc\u0131 izni ya da mahkeme karar\u0131 olmadan g\u00f6zlem alt\u0131na al\u0131namaz.<\/p>\n<p><b>Madde<\/b><b> 44- <\/b>Hi\u00e7bir durumda \u00f6l\u00fcm cezas\u0131 verilemez.<\/p>\n<p>ALTINCI B\u00d6L\u00dcM * ADALET S\u0130STEM\u0130 VE MAHKEMELER<\/p>\n<p><b>Madde<\/b><b> 45- <\/b>Adalet, \u00f6rg\u00fctl\u00fc halk ile birlikte ve onun ad\u0131na, \u00e7al\u0131\u015fma kural ve esaslar\u0131 yasalarca belirlenmi\u015f mahkemelerce yerine getirilir. Adalet mekanizmas\u0131 mahalle ve k\u00f6y meclisleri esas al\u0131nmak \u00fczere olu\u015fturulur. Mahkemelerde gerek bu meclislerce belirlenen yurtta\u015flar, gerekse meslekten yarg\u0131\u00e7lar g\u00f6rev al\u0131rlar. Yarg\u0131\u00e7lar\u0131n ve yurtta\u015flar\u0131n ne \u015fekilde g\u00f6reve gelece\u011fi yasalar taraf\u0131ndan tayin edilir.<\/p>\n<p><b>Madde<\/b><b> 46- <\/b>Yasalarca belirlenecek usullerle kurulmu\u015f ve g\u00f6rev yapan mahkemelerin en \u00fcst organ\u0131 Y\u00fcksek Mahkeme\u2019dir. Y\u00fcksek Mahkeme, T\u00fcrkiye Cumhuriyeti s\u0131n\u0131rlar\u0131 dahilinde faaliyet g\u00f6steren t\u00fcm mahkemelerin kararlar\u0131n\u0131n nihai olarak g\u00f6zden ge\u00e7irildi\u011fi, faaliyetlerinin denetlendi\u011fi yarg\u0131 uzvudur. Adalet sisteminin birli\u011fini temsil eder, \u00fcyelerinin se\u00e7imi ve i\u015fleyi\u015f usulleri yasayla belirlenir ve ba\u011f\u0131ms\u0131z faaliyeti devlet taraf\u0131ndan g\u00fcvence alt\u0131na al\u0131n\u0131r. Y\u00fcksek Mahkemenin verdi\u011fi kararlar kesindir.<\/p>\n<p><b>Madde<\/b><b> 47- <\/b>Yarg\u0131\u00e7lar ba\u011f\u0131ms\u0131zd\u0131r; g\u00f6revlerini y\u00fcr\u00fct\u00fcrken yaln\u0131z yasalara ba\u011f\u0131ml\u0131 olurlar; yarg\u0131\u00e7lar\u0131n ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 etkileyecek m\u00fcdahalelere kar\u015f\u0131 devlet \u00f6nlem almakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p><b>Madde<\/b><b> 48- <\/b>Ceza ve infaz yasalar\u0131, su\u00e7lar\u0131n \u00f6nemli bir b\u00f6l\u00fcm\u00fc toplumsal kaynakl\u0131 oldu\u011fundan, toplumun su\u00e7a kar\u015f\u0131 korunmas\u0131 gere\u011fi g\u00f6z ard\u0131 edilmeksizin, bireye toplumsal ya\u015fant\u0131da yer alma bilincinin ve yeteneklerinin sa\u011flanmas\u0131 do\u011frultusundaki politikalar\u0131 i\u00e7erir.<\/p>\n<p><b>Madde<\/b><b> <\/b><b>49-<\/b><b> <\/b>Yurtta\u015flar\u0131n ve Cumhuriyet s\u0131n\u0131rlar\u0131 i\u00e7erisinde ya\u015fayan herkesin fillerinin yasalara uygunlu\u011funu denetleyen merci Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131\u2019d\u0131r. Ba\u015fsavc\u0131l\u0131k kendisine ba\u011fl\u0131 ve dikey bi\u00e7imde \u00f6rg\u00fctlenmi\u015f savc\u0131lardan olu\u015fan bir yap\u0131ya sahiptir. Ba\u015fsavc\u0131l\u0131\u011f\u0131n i\u015fleyi\u015f usulleri kanunla belirlenir. Yarg\u0131lama her a\u015famada a\u00e7\u0131kt\u0131r. Yarg\u0131laman\u0131n kamuya kapal\u0131 olarak s\u00fcrd\u00fcr\u00fclmesi, ancak san\u0131\u011f\u0131n ya da ma\u011fdurun ki\u015fisel haklar\u0131n\u0131n \u00e7i\u011fnenmemesi amac\u0131yla ve yine kendilerinin r\u0131zas\u0131yla m\u00fcmk\u00fcn olabilir.<\/p>\n<p>YED\u0130NC\u0130 B\u00d6L\u00dcM * DI\u015e POL\u0130T\u0130KA VE SAVUNMA<\/p>\n<p><b>Madde<\/b><b> 51- <\/b>T\u00fcrkiye Cumhuriyeti, emperyalizmin hi\u00e7bir askeri, ekonomik, mali, k\u00fclt\u00fcrel ve siyasal \u00f6rg\u00fctlenmesinin \u00fcyesi veya bir par\u00e7as\u0131 olamaz, bu t\u00fcr \u00f6rg\u00fctlenmelerle birlikte hareket edemez.<\/p>\n<p><b>Madde<\/b><b> 52- <\/b>T\u00fcrkiye Cumhuriyeti, e\u015fit kat\u0131l\u0131m\u0131 sa\u011flayan, kar\u015f\u0131l\u0131kl\u0131 \u00e7\u0131karlar\u0131 koruyan ve bar\u0131\u015fa hizmet eden b\u00fct\u00fcn uluslararas\u0131 kurulu\u015flarda yer al\u0131r. T\u00fcrkiye Cumhuriyeti, emperyalizmin g\u00fcc\u00fcn\u00fc ve etkinli\u011fini geriletmeyi ve ortadan kald\u0131rmay\u0131 ama\u00e7 edinen b\u00f6lgesel\/ uluslararas\u0131 birlikteliklerin olu\u015fturulmas\u0131 ve g\u00fc\u00e7lendirilmesi i\u00e7in \u00f6nc\u00fc, y\u00f6nlendirici ve destekleyici tutumlar sergiler.<\/p>\n<p><b>Madde<\/b><b> 54- <\/b>Her yurtta\u015f\u0131n enternasyonalist ve yurtsever bilincinin geli\u015fmesi ve canl\u0131 tutulmas\u0131 i\u00e7in gereken \u00f6nlemler al\u0131n\u0131r.<\/p>\n<p><b>Madde<\/b><b> 55- <\/b>Kom\u00fcnist, sosyalist, antiemperyalist, anti-fa\u015fist, sava\u015f aleyhtar\u0131 g\u00f6r\u00fc\u015fleri nedeniyle kendi \u00fclkelerini terk etmek zorunda b\u0131rak\u0131lan ki\u015filer, T\u00fcrkiye Cumhuriyeti&#8217;nin g\u00fcvencesi alt\u0131ndad\u0131r.<\/p>\n<p><b>Madde<\/b><b> 56- <\/b>Savunma ve g\u00fcvenlik hizmetleri \u015fu esaslara g\u00f6re d\u00fczenlenir:<\/p>\n<ul>\n<li>T\u00fcrkiye Cumhuriyeti&#8217;nin temel savunma unsuru, silahl\u0131 kuvvetlerdir.<\/li>\n<\/ul>\n<ul>\n<li>Silahl\u0131 kuvvetler, toplumun hizmetindedir. Silahl\u0131 kuvvetlerin toplumdan uzakla\u015fmas\u0131 ve kastla\u015fmas\u0131 \u00f6nlenir. Silahl\u0131 kuvvetler bar\u0131\u015f zamanlar\u0131nda \u00fcretim s\u00fcrecinde g\u00f6rev \u00fcstlenir.<\/li>\n<\/ul>\n<ul>\n<li>Askerlik, kad\u0131n ve erkek b\u00fct\u00fcn T\u00fcrkiye Cumhuriyeti yurtta\u015flar\u0131n\u0131n g\u00f6revidir. Toplum ve devlet, bu b\u00fct\u00fcn\u00fcn uyumlu, sa\u011fl\u0131kl\u0131 ve eksiksiz geli\u015fmesinden sorumludur.<\/p>\n<p><b>Madde<\/b><b> 58- <\/b>Bireylerin kendilerini toplumsal olarak ifade edebilmeleri, kolektif bilince sahip, insanlar\u0131n ve b\u00fct\u00fcn uluslar\u0131n e\u015fitli\u011fi ve karde\u015fli\u011fine inanan ki\u015filer olarak yeti\u015fmeleri i\u00e7in e\u011fitim, kitle ileti\u015fimi, siyasal ve k\u00fclt\u00fcrel ya\u015fam, sa\u011fl\u0131k, spor etkinlikleri gibi alanlar ayr\u0131 ayr\u0131 de\u011fil bir b\u00fct\u00fcn olarak de\u011ferlendirilmek zorundad\u0131r.<\/p>\n<p><b>Madde<\/b><b> 59- <\/b>E\u011fitim her a\u015famas\u0131nda paras\u0131z sunulan kamusal bir hizmet olarak toplumun \u00e7\u0131karlar\u0131 do\u011frultusunda yeniden \u00f6rg\u00fctlenir. Dileyen herkes, bilimsel olarak \u00f6ng\u00f6r\u00fclm\u00fc\u015f ba\u015far\u0131 \u00f6l\u00e7\u00fctlerini yerine getirmek ko\u015fuluyla, \u00f6\u011frenimini son a\u015famas\u0131na kadar s\u00fcrd\u00fcr\u00fcr. E\u011fitim imkanlar\u0131 t\u00fcm toplumsal kesimlere e\u015fit olarak sunulur ve e\u011fitimden yararlanmada ortaya \u00e7\u0131kabilecek e\u015fitsizliklerin \u00f6n\u00fcne ge\u00e7mek i\u00e7in \u00f6zel \u00f6nlem al\u0131n\u0131r.<\/p>\n<p><b>Madde<\/b><b> 60- <\/b>E\u011fitimin, insan\u0131n yeteneklerini ve yarat\u0131c\u0131 g\u00fcc\u00fcn\u00fc ortaya \u00e7\u0131kar\u0131p geli\u015ftiren bilimsel i\u00e7erikli bir etkinli\u011fe d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesinin yan\u0131 s\u0131ra, s\u0131n\u0131fs\u0131z-s\u00f6m\u00fcr\u00fcs\u00fcz bir d\u00fcnya i\u00e7in verilen m\u00fccadeleye bilimsel ve ahlaki a\u00e7\u0131lardan yard\u0131mc\u0131 olma i\u015flevini de yerine getirmesi sa\u011flan\u0131r.<\/p>\n<p><b>Madde<\/b><b> 61- <\/b>Herkesin istedi\u011fi alanda e\u011fitim g\u00f6rmesi, toplumun ihtiya\u00e7lar\u0131 da g\u00f6zetilerek ger\u00e7ekle\u015ftirilir.<\/p>\n<p><b>Madde<\/b><b> 62- <\/b>E\u011fitim politikalar\u0131nda ilgili kurumlar\u0131n b\u00fct\u00fcn \u00f6\u011feleri s\u00f6z sahibidir. \u00d6\u011fretmenler, \u00f6\u011frenciler, veliler ve e\u011fitim kurumlar\u0131ndaki hizmet i\u015f\u00e7ileri ayr\u0131 ve birle\u015fik \u00f6rg\u00fctlenmelerle e\u011fitim politikalar\u0131n\u0131n olu\u015fturulmas\u0131na kat\u0131l\u0131rlar.<\/p>\n<p><b>Madde<\/b><b> 63- <\/b>Ana dilde e\u011fitim, devletin g\u00fcvencesi alt\u0131ndad\u0131r. \u00dclkemizde ve b\u00f6lgemizde ya\u015fayan halklar\u0131n birbirlerinin dil ve k\u00fclt\u00fcrlerini daha yak\u0131ndan tan\u0131malar\u0131, e\u011fitim sisteminin ama\u00e7lar\u0131 aras\u0131nda yer al\u0131r.<\/p>\n<p><b>Madde<\/b><b> 64- <\/b>Yabanc\u0131 dil e\u011fitimi, insanl\u0131\u011f\u0131n k\u00fclt\u00fcrel ve bilimsel birikiminden m\u00fcmk\u00fcn olan en b\u00fcy\u00fck \u00f6l\u00e7\u00fcde yararlanmay\u0131 ve halklar aras\u0131ndaki karde\u015fli\u011fi g\u00fc\u00e7lendirmeyi g\u00f6zeten bir yakla\u015f\u0131m do\u011frultusunda ger\u00e7ekle\u015ftirilir.<\/p>\n<p><b>Madde<\/b><b> 65- <\/b>Ya\u015flar\u0131 18\u2019in alt\u0131ndaki \u00e7ocuklar ile gen\u00e7lerin, e\u011fitim s\u00fcrecinin bir par\u00e7as\u0131 olmayan i\u015flerde \u00e7al\u0131\u015fmalar\u0131 ya da \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 yasakt\u0131r.<\/p>\n<p><b>Madde<\/b><b> <\/b><b>66-<\/b><b> <\/b>Okuma-yazma bilmeyen tek bir yurtta\u015f\u0131n kalmamas\u0131, toplumun ba\u015fl\u0131ca<\/p>\n<p>\u00f6devleri aras\u0131ndad\u0131r. Konutlar\u0131n deprem, sel ve \u00f6teki do\u011fa olaylar\u0131ndan etkilenmeyecek yap\u0131da \u00fcretilmeleri ya da bu \u00f6zel- liklere sahip duruma getirilmeleri i\u00e7in her t\u00fcrl\u00fc \u00f6nlem al\u0131n\u0131r. Konutlarda \u0131s\u0131nma, elektrik enerjisi ve su bedelsiz olarak sa\u011flan\u0131r.<\/p>\n<p><b>Madde<\/b><b> 71- <\/b>Kad\u0131n ile erkek aras\u0131nda toplumsal etkinlik ve toplumsal roller a\u00e7\u0131s\u0131ndan tarihsel s\u00fcre\u00e7 i\u00e7inde ortaya \u00e7\u0131km\u0131\u015f ayr\u0131m ve \u00e7eli\u015fkilerin yok edilmesi zorunludur. Bu zorunlulu\u011fun \u00fcr\u00fcn\u00fc olan yasalarla g\u00fcvenceye al\u0131nan kad\u0131n haklar\u0131n\u0131n ya\u015fam\u0131n b\u00fct\u00fcn alanlar\u0131nda ger\u00e7ek ve kal\u0131c\u0131 kazan\u0131mlara d\u00f6n\u00fc\u015fmesi do\u011frultusunda m\u00fccadele etmek, cinselli\u011fin kad\u0131n\u0131 a\u015fa\u011f\u0131lay\u0131c\u0131 roller edinmesine ve kad\u0131nlara y\u00f6nelik her t\u00fcrl\u00fc ayr\u0131mc\u0131l\u0131\u011fa kar\u015f\u0131 durmak, b\u00fct\u00fcn toplumun sorumlulu\u011fundad\u0131r.<\/p>\n<p><b>Madde<\/b><b> 72- <\/b>Kad\u0131n\u0131n ev i\u015flerine ve \u00e7ocuk bak\u0131m\u0131na ba\u011f\u0131ml\u0131l\u0131\u011f\u0131n\u0131n nedeni olan cinsiyet farkl\u0131l\u0131\u011f\u0131na dayal\u0131 i\u015fb\u00f6l\u00fcm\u00fc b\u00fct\u00fcn toplumsal ve ideolojik y\u00f6nleriyle tasfiye edilir. Bu do\u011frultuda, yemek, temizlik ve \u00e7ocuk bak\u0131m\u0131 gibi y\u00fckler, her t\u00fcrl\u00fc kolektif olanak seferber edilerek toplumun b\u00fct\u00fcn\u00fc taraf\u0131ndan \u00fcstlenilir.<\/p>\n<p><b>Madde<\/b><b> 73- <\/b>Kad\u0131nlar\u0131n siyasal ve k\u00fclt\u00fcrel ya\u015fama etkin ve yayg\u0131n bi\u00e7imde kat\u0131lmalar\u0131 te\u015fvik edilir ve bu do\u011frultuda her t\u00fcr \u00f6rg\u00fctsel olanak yarat\u0131l\u0131r.<\/p>\n<p><b>Madde<\/b><b> 74- <\/b>Ailenin sevgi temelinde g\u00f6n\u00fcll\u00fc bir birlikteli\u011fe d\u00f6n\u00fc\u015fmesi, ba\u015fl\u0131ba\u015f\u0131na bir ama\u00e7 olu\u015funun yan\u0131 s\u0131ra, kad\u0131n haklar\u0131n\u0131n geli\u015ftirilmesi bak\u0131m\u0131ndan da \u00f6nemlidir ve bu sorun hem yasal d\u00fczenlemelerin hem de toplumsal-k\u00fclt\u00fcrel bir m\u00fccadelenin konusu olarak ele al\u0131n\u0131r.<\/p>\n<p><b>Madde<\/b><b> 75- <\/b>\u00c7ocuklar\u0131n bak\u0131m\u0131, beslenmesi, sa\u011fl\u0131kl\u0131 bireyler olarak geli\u015fimi ve e\u011fitimi, devletin g\u00fcvencesi alt\u0131ndad\u0131r.<\/p>\n<p><b>Madde<\/b><b> 76- <\/b>Gen\u00e7lerin m\u00fcmk\u00fcn olan en erken ya\u015ftan ba\u015flayarak toplumsal ya\u015fam\u0131n b\u00fct\u00fcn\u00fcne, siyasal karar alma s\u00fcre\u00e7lerine, k\u00fclt\u00fcrel, sanatsal, bilimsel \u00fcretime kat\u0131labilmeleri \u00f6zendirilir. Par\u00e7as\u0131 olduklar\u0131 e\u011fitim ya da spor kurumlar\u0131nda, bulunduklar\u0131 y\u00f6relerde ve topluluklarda \u00f6teki yurtta\u015flarla e\u015fit hak ve sorumluluklara sahip olmalar\u0131 i\u00e7in olanak sa\u011flan\u0131r. Gen\u00e7lerin yarat\u0131c\u0131 enerjisini b\u00fct\u00fcn bask\u0131lardan kurtararak a\u00e7\u0131\u011fa \u00e7\u0131karmak ve gen\u00e7li\u011fi her alanda \u00f6zg\u00fcrle\u015ftirmek, toplumsal bir \u00f6devdir.<\/p>\n<p><b>Madde<\/b><b> 77- <\/b>Ya\u015fl\u0131lar toplumsal etkinliklerden uzakla\u015ft\u0131r\u0131larak kimsesiz ve desteksiz b\u0131rak\u0131lamaz. Ya\u015fl\u0131lar\u0131n toplumun e\u015fit, bak\u0131ml\u0131, kamusal ya\u015fama kat\u0131lmalar\u0131 \u00f6zendirilip desteklenen yurtta\u015flar olarak ya\u015famalar\u0131 i\u00e7in gerekli b\u00fct\u00fcn maddi ve manevi ko\u015fullar yarat\u0131l\u0131r.<\/p>\n<p><b>Madde<\/b><b> 78- <\/b>Engelli yurtta\u015flar\u0131n e\u011fitim ve \u00fcretim s\u00fcre\u00e7leri ile siyasal ve toplumsal ya\u015fama kat\u0131lmalar\u0131n\u0131n ko\u015fullar\u0131 s\u00fcrekli olarak geli\u015ftirilir. Engelli yurtta\u015flarla ilgili d\u00fczenlemelere ili\u015fkin kararlar engelli yurtta\u015flar\u0131n \u00f6rg\u00fctleriyle birlikte al\u0131n\u0131r.<\/p>\n<p><b>Madde<\/b><b> 79- <\/b>Sanat yeni toplumun yarat\u0131l\u0131\u015f\u0131na ve yeni insan\u0131n kendini \u00f6zg\u00fcrce geli\u015ftirmesine katk\u0131 sa\u011flayacak en \u00f6nemli alanlardan biridir. Sanatla yarat\u0131c\u0131 ve izleyici olarak u\u011fra\u015fmak, her yurtta\u015f\u0131n hakk\u0131d\u0131r. Bu hakk\u0131n kullan\u0131labilirli\u011fini sa\u011flamak, toplumun ve devletin sorumlulu\u011fundad\u0131r.<\/p>\n<p><b>Madde <\/b><b>80- <\/b>Sanat\u00e7\u0131 yarat\u0131c\u0131l\u0131\u011f\u0131n\u0131n \u00f6zg\u00fcrle\u015fmesi, temel hedeflerden biridir. Sanat\u0131n ve sanat \u00fcr\u00fcnlerinin metala\u015fmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilir. Sanat\u0131n \u00f6zg\u00fcr bir ortamda toplumsalla\u015fmas\u0131, sanat emek\u00e7ilerinin \u00f6rg\u00fctlenmesi, sanat\u0131n insana ula\u015fmas\u0131n\u0131 \u00f6nleyen b\u00fct\u00fcn engellerin kald\u0131r\u0131lmas\u0131 i\u00e7in gereken b\u00fct\u00fcn \u00f6nlemler al\u0131n\u0131r.<\/p>\n<p><b>Madde<\/b><b> 81<\/b>&#8211; Sanat\u00e7\u0131lar\u0131n kendilerine ayr\u0131lan toplumsal olanaklar\u0131 \u00f6rg\u00fctl\u00fc ve kolektif olarak kullanmalar\u0131 sa\u011flan\u0131r.
